These Terms of Use govern the use of the website koetzingit.de (hereinafter referred to as the „Website“) as well as the content and features offered on it (e.g., blog posts, comment feature, links to downloads).

Usage Rights: By posting a comment, you grant the provider the non-exclusive right, without any time or geographical restrictions, to store, display, and technically process the comment for the purpose of operating the website. You retain all copyrights to your contributions; the provider will not engage in any further commercial use of your contributions beyond this.

Host: There is no right to have a comment published. The provider is entitled to edit, block, or delete posts that violate these terms or applicable law without prior notice. There is no obligation to continuously monitor posted content; the limitation of liability for third-party content under the Digital Services Act (DDG) remains unaffected.

Exemption: If the content you have posted infringes the rights of third parties, you shall indemnify the provider against any resulting valid claims by third parties, to the extent that you are responsible for the infringement.

The content provided on GitHub is subject to the terms of use and privacy policy of the respective operator (GitHub, Inc.) as posted there. The use of the respective code is governed exclusively by the the license stored in the respective repository is decisive.

Use is at your own risk. Scripts and tools are provided without any warranty as to their functionality, accuracy, or fitness for a particular purpose. The provider recommends testing downloads in a test environment before using them in production environments. The liability provisions in Section 7 remain unaffected.

6. External Links

The website contains links to external third-party websites over whose content the provider has no control. The respective provider or operator of those sites is always responsible for their content. At the time the links were posted, no illegal content was apparent. It is not reasonable to expect the provider to continuously monitor the content of the linked sites without specific evidence of a legal violation. If legal violations become known, the corresponding links will be removed immediately.

7. Liability

The provider bears unlimited liability in cases of willful misconduct and gross negligence, as well as in cases of injury to life, body, or health.

In cases of simple negligence, the provider is liable only for a breach of a material contractual obligation (cardinal obligation) whose fulfillment is essential for the proper use of the website and on whose compliance you may reasonably rely. In this case, liability is limited to foreseeable damages typical for this type of contract.

Furthermore, liability is excluded—in particular, for the timeliness, completeness, and accuracy of the content provided, as well as for damages resulting from the use of downloads.

Liability under the Product Liability Act and to the extent of any warranty provided remains unaffected.

9. Changes to the Terms of Use

The provider reserves the right to amend these Terms of Use with future effect to the extent necessary for legal or technical reasons. The version published on the website at the time of use shall apply.

10. Governing Law and Final Provisions

The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the user has his or her habitual residence remain unaffected.

If any provision of these Terms of Use is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
